But the preservation effort (which I strongly support) is futile unless
there will be access. So I would have thought that you would at least
have *informed* the rights owners of what you are doing, at least partly
to prevent them getting the impression that you would violate copyright
but also to sound out, informally, their views on the exploitation of
your work.

Indeed; they might require royalty in addition to, or instead of, an
initial licence fee.
